The lawsuit against MUD in the Omaha fire that destroyed M’s Pub continues

(AP) – OMAHA, Neb .– The Nebraska Supreme Court allows a lawsuit against an Omaha natural gas utility to continue over a 2016 fire that destroyed part of the old downtown Omaha market, including M’s Pub .

Friday’s ruling confirms a lower court finding that the Metropolitan Utilities District’s motion to excuse the summary judgment of the lawsuit has been denied. MUD had argued in the inquiry that it was immune to the lawsuit.

The Nebraska Lower Court and Supreme Court justices disagreed and determined that MUD was required by law and its own guidelines to ensure that the lines were clearly labeled so that in the event of a gas fire, the gas was immediately released by MUD should be turned off and to ensure that abandoned gas lines are properly exited.

The plaintiffs in the case say MUD failed on all three.
